TERMS: The land is to be sold for Cash. All financial arrangements must be made prior to the Auction. The sale is subject to Seller confirmation. However it is the Seller’s desire to sell to the highest and best bidder. The Sale Day Deposit will be made day of sale upon being the successful bidder which will require signing the Purchase Agreement. Buyers agree to co-operate with the Seller(s) in using a 10-31 Tax Deferred exchange at no expense to the Buyer. The deposit will be applied to the purchase price with the balance due at closing on or before May 21, 2013.
MANNER OF SALE: Tracts will be offered individually and as a Unit.
TITLE: The Seller’s will convey property by applicable Warranty Deed supported by Title Insurance, showing clear  title at a cost of 1/2 to Seller and 1/2 to Buyer.
TAXES: Seller agrees to pay customary closing costs and taxes to December 31, 2012.
MINERALS: The Sellers are reserving no minerals. All available minerals remain with the land.
POSSESSION: Buyer will have possession on closing subject to the current lease for the 2013 crop year. The Buyer will have full possession of the Home, Grassland and Dryland farm ground. The Buyer will receive a Landlord’s 40% rent share on the 2013 crop production. The expenses for the crop are shared as the lease and any expenses incurred by the Seller (as Landlord) will be the Buyer’s obligation in return for a 40% share of the crop.
CROP INSURANCE The Landlord’s crop insurance will also be a benefit to the Buyer. The Buyer will be required to assume the crop insurance and it’s premium which provides for an 85% revenue protection based on a 188 bu. (Tract 1) and 184 bu. (Tract 2) proven yield! This guarantees $361.00 and $354.00 per planted acre for the Buyer!
The property will be sold subject to existing property lines.
