TERMS: The land is to be sold for Cash. All Financial Arrangements Must Be Made Prior to the Auction. The sale is subject to Seller confirmation. However, it is the Seller’s desire to sell to the highest and best bidder. The Deposit will be made in good funds the day of sale upon being the successful bidder, which will require signing the Purchase Agreement. The deposit will be applied to the purchase price with the balance due at closing on or before March 7th, 2018.
MANNER OF SALE: Tracts will be sold individually. The property will be sold by the legal description.
TITLE: The Seller will convey property by Warranty Deed supported by Title Insurance at a cost of 1/2 to Seller and 1/2 to Buyer.
MINERALS: The Seller is reserving a One-Half Non-Participating Interest in Oils, Gases & Minerals for 15 years from date of Deed. In event of production this reservation shall continue for as long as production exists in commercial paying quantities.
POSSESSION: The Buyer will receive a 1/3 (Landlord’s) share of the 2018 crop. The Buyer will be responsible for 1/3 of the spring chemical and fertilizer cost applied to the growing crop. Buyer will have full possession of the stubble land on closing. The Tenant will be responsible to harvest the 2018 crop and deliver it to the elevator.
